TERMS AND CONDITIONS OF PURCHASE

  1. About MrCAP
  • The company is registered in Stockholm. The company’s postal address is 114 20.
  • If you wish to contact us, please email info@mrcap.com with your enquiry and contact details, and we will get back to you shortly.

 

  1. Order
  • Once you have completed your order, an order confirmation will be sent to your email address. The confirmation contains all details about the products, price, billing address and delivery address.
  • If there is any error in the order confirmation, you must contact us immediately by email at info@mrcap.com.

 

  1. Delivery
  • Our standard delivery time is 3–5 days. NOTE: Orders placed on weekends are dispatched no earlier than the following Monday.
  • If any delivery delays occur (without us having informed you of a longer delivery time), please contact us by email at info@mrcap.com.

 

  1. Prices
  • All prices in the shop are stated in SEK and all prices include 25% VAT.
  • We reserve the right to change prices due to price changes from suppliers, typographical errors in the price list, and incorrect prices resulting from inaccurate information, and we reserve the right to adjust the price.

 

  1. Right of Withdrawal
  • When purchasing goods on the website, you as a customer have a statutory 14-day right of withdrawal, which applies from the time you have received the item you ordered.

5.1 When exercising your right of withdrawal:

  • You must notify us that you wish to withdraw. The notice must be sent to us at info@mrcap.com. Your message must clearly state your name, address, email address, order number, and which items the return concerns.
  • You should return the products to us immediately and no later than within the statutory 14 days after the withdrawal notice.
  • You are responsible for return shipping, delivery, and the condition of the products upon return; the products should therefore be sent well packaged and in their original packaging.
  • We reserve the right to deduct an amount corresponding to the depreciation compared to the item’s original value in the event of a used or damaged product from the refund amount.

5.2 The right of withdrawal does not apply to:

  • Products that have been sealed for health or hygiene reasons and where the seal has been broken by you.
  • Products that consist of sealed audio or video recordings where the seal has been broken by you.
  • Custom-made products that have been tailored specifically for you or have a clear personal character based on your wishes.
  • Services that have been fully performed and where you have expressly consented to the service starting without a right of withdrawal.
  • Goods that can deteriorate quickly, such as food.

  1. Claims and Complaints
  • We inspect all products before they are sent to you. Should the product nevertheless be damaged or incorrectly supplied upon arrival, we undertake, in accordance with applicable consumer protection legislation, to remedy the fault free of charge.
  • You must always contact us for approval before returning a defective item.
  • The complaint must be submitted immediately after the defect has been discovered.

6.1 How do you proceed when making a claim?

  • Any faults and defects must always be reported to info@mrcap.com, stating your name, address, email address, order number, and a description of the fault.
  • If we are unable to remedy the fault or deliver a similar product, we will refund you for the defective product in accordance with applicable consumer protection legislation. We cover return shipping for approved claims.
  • We reserve the right to reject a claim if it turns out that the item is not defective in accordance with applicable consumer protection legislation. For claims, we follow the guidelines of the National Board for Consumer Disputes, see arn.se.

 

  1. Limitation of Liability
  • We accept no liability for indirect damage that may arise due to the product.
  • We accept no liability for delays/errors due to circumstances beyond the company’s control (Force Majeure). Such circumstances may include labour disputes, fire, war, government decisions, reduced or failed deliveries from suppliers.
  • Furthermore, we accept no liability for any changes to products/product characteristics made by the respective supplier and other factors beyond our control.

 

  1. Product Information
  • We reserve the right for any typographical errors on this website and for products being sold out. We do not guarantee that the images reproduce the products’ exact appearance, as some colour variation may occur depending on the monitor, photo quality and resolution. We always strive to present the products as accurately as possible.

 

  1. Information about Cookies
  • Under the Electronic Communications Act, visitors to a website must, for privacy reasons, be informed that cookies are used. The information in the cookie can be used to track a user’s browsing. A cookie is a small text file that the website you visit requests permission to store on your computer in order to provide access to various functions.   • By shopping with MrCAP, you accept our privacy policy and our processing of your personal data. We value your privacy and do not collect more data than necessary to process your order. We never sell or disclose your data to third parties without a legal basis.
  • MrCAP is responsible for the processing of personal data that you provide to us as a customer. We process your personal data in order to manage your order and, where you have requested newsletters or promotional offers, to tailor marketing to your individual needs.
  • The information below is a summary of how, in accordance with the General Data Protection Regulation (GDPR), we store and process your data.

10.1 What is personal data?
Personal data is any information that can be directly or indirectly linked to a natural person.

10.2 What data do we store?
In order to manage your order and respond to questions related to your order (customer service), we store your first and last name, address, phone number, email address, IP address, and purchase history.

  • Your data is stored for as long as we have a legal basis to process it, for example to fulfil the agreement between us or to comply with a legal obligation under, for example, the Swedish Bookkeeping Act.

10.3 Legal basis
In connection with a purchase, your personal data is processed in order to fulfil the agreement with you.
Marketing, campaigns and similar communications are sent based on your consent.

10.4 What data is shared and for what purpose?
10.4.1 Payment provider

  • When completing a purchase, information is shared with our payment provider. The data stored is first name, last name, address, email address and phone number. If you choose to pay by invoice, your personal identity number is also stored by the payment provider. The information is stored in order to complete the purchase and to protect the parties against fraud.
    The payment provider we use is Klarna.

10.4.2 Shipping company
In order to deliver your orders and fulfil our agreement, we must share certain information with the shipping company. The information shared with the shipping company is first name, last name, and delivery address details. Email address and/or mobile number may also be shared with the shipping company for notifications.
The shipping companies we work with are: DHL, Postnord.

10.4.3 Newsletter
If you have chosen to subscribe to our newsletter, your first name, last name and email address are shared with our newsletter provider. This is to keep you updated with information and offers for marketing purposes.
We use GetANewsLetter for sending newsletters.

10.5 Right of access
You have the right to obtain an extract of all information we hold about you. The extract is delivered electronically in a readable format.

10.6 Right to rectification
You have the right to ask us to update incorrect information or to supplement information that is incomplete.

10.7 Right to be forgotten
You may request at any time that data relating to you be erased. There are a few exceptions to the right to erasure, such as when it must be retained in order for us to comply with a legal obligation (for example under the Swedish Bookkeeping Act).

10.8 Data protection officer
MrCAP is responsible for the storage and processing of personal data in the online shop and ensures that the rules are complied with.

10.9 How we protect your personal data
We use industry standards such as SSL/TLS and one-way hash algorithms to store, process and communicate sensitive information, such as personal data and passwords, securely.
We use a Swedish platform, Quickbutik, operated by Quickbutik AB, headquartered in Helsingborg.

 

  1. Changes to the General Terms and Conditions
  • We reserve the right to make changes to the terms and conditions at any time. Changes to the terms and conditions will be published online on the website. The amended terms and conditions are deemed accepted in connection with an order or a visit to the website.

 

  1. Disputes and choice of law
  • If a dispute cannot be resolved amicably between the company’s customer service and the customer, you as a customer may contact the National Board for Consumer Disputes, see arn.se. For residents of an EU country other than Sweden, complaints can be submitted online via the European Commission’s platform for dispute resolution, see http://ec.europa.eu/consumers/odr
  • In the event of a dispute, we follow decisions from ARN or an equivalent dispute resolution body.
  • Any dispute regarding the interpretation or application of these general terms and conditions shall be governed by Swedish law.
